PURCHASE AGREEMENT (PREVIEW)

Fino Lagotto (“Seller”) owns a Lagotto Romagnolo dog.

I,Buyer's full name

,(“Buyer”) desire to purchase the Lagotto Romagnolo (“Canine”) described above.Now, therefore, in consideration of mutual promises contained in this agreement, Seller agrees to sell and Buyer agrees to buy Canine for

$"Purchase Price"

(“Purchase Price"), transferring full title and possession ofCanine from Seller to Buyer as of the date of this agreement. The following warranties and conditions apply, and both Buyer and Seller agree that no other warranties or conditions are expressed or implied other than those stated herein.

  1. Seller warrants that Seller holds full title to Canine free of any security agreement or other encumbrance. Seller retains the right in regard toCanine for a yearly-prearranged visit to Buyer's home at Seller's expense.
  2. Canine is purebred and pedigree is true and correct to the best of Seller's knowledge. 
  3. Canine is guaranteed to be in good health and free of communicable diseases at the time of sale.
  4. Canine is guaranteed to five (5) years of age against any genetic defect that may arise that will lead to Canine's death. Should a claim arise under the terms of this agreement, Seller shall refund the PurchasePrice to Buyer after confirmation of the claim. The Buyer may keepCanine if desired.
  5. Canine is guaranteed against hip dysplasia as certified by PennHip orOFA at the age of two (2) years. This guarantee specifically excludes dysplasia caused by environmental factors, a deviation from the required feeding practices or Buyer mishandling. Canine will stay placed with Buyer and decision on how to handle the hip dysplasia will be by the Buyer and his/her veterinarian at Buyer's expense.Seller shall refund the Purchase Price after confirmation of a claim.Seller retains the right to refuse to sell future Canines to Buyer.
  6. All medical bills and other incurred expenses of showing or training are the responsibility of the Buyer.
  7. The Buyer agrees to keep Canine for as long as he/she lives, unless unforeseen circumstances arise. Should the Buyer not be able to care for this Canine, the Seller must be notified first and given first option to reclaim Canine. This Canine may not be placed in another home without the written consent of Seller.
  8. Seller agrees to take possession and title of Canine, regardless of its age or physical condition, if the Buyer so requests.
  9. Buyer has four (4) weeks from the date of delivery of Canine to Buyer to decide if Canine is a good fit with Buyer's family and that Buyer can abide all the terms and conditions of this Purchase Agreement. At any time during those four (4) weeks, Buyer can return Canine for a full refund of the Purchase Price. Delivery costs will be born by Buyer. Anytime during Canine's life after these four (4) weeks,Canine may be returned to Seller for a refund of $1,000.00 (one thousand dollars).
  10. Buyer is required to follow feeding guidelines set by Seller. These guidelines help guarantee Canine's continuing good health. IfSeller's recommendations are not followed regarding diet, the aforementioned hip-dysplasia warranty is voided.
  11. Buyer agrees to pay the cost of obtaining a Penn Hip or OFA certifiable hip x-rays between 12 and 24 months of age, and to send copies of the report to Seller. Buyer shall insure delivery of x-rays or reports to Seller. Seller agrees to pay all costs associated with the certification itself.
  12. Canine must be spayed or neutered at Buyer's expense. All puppies sold by Seller are represented to Buyer as "pet-quality" only.
  13. This agreement constitutes the entire agreement between Seller and Buyer, and supersedes any and all earlier negotiations or agreements.
  14. This agreement cannot be modified except in writing signed by both Buyer and Seller.
  15. This agreement shall be governed by and construed in accordance with the laws of the State of New Mexico.
  16. Venue for any action under this agreement shall lie in Santa Fe County, New Mexico.
  17. In the event that a court of competent jurisdiction enters a final judgment holding invalid any portion of this Purchase Agreement, the remainder of this Purchase Agreement shall be fully enforceable.
BUYER'S WARRANTIES

A. Buyer agrees to never place a choke, shock or prong collar on Canine.Buyer understands that to do so would be to approve of the surrender of the dog to Seller at a flat return rate of $500.00.

B. Buyer agrees to provide Canine with a daily opportunity to run for at least 30 minutes off leash. Buyer also agrees to provide daily enrichment,which may include attendance at a daycare, leash walks, retrieval game sand tug of war. Buyer understands that to not do so would be to approve the surrender of Canine to Seller for a flat rate of $500.00.

C. Buyer agrees to provide Canine with edible chews during its lifetime.Buyer understands that depriving Canine of edible, ingestible bones and chews will compromise Canine's health and well being. Buyer understands that by not providing these foods on a daily basis, Buyer is approving the surrender of Canine to Seller for a refund of $500.00.

D. Buyer agrees to feed Canine half of its total food intake in the form of raw, meaty bones. This includes chicken drumsticks, pork necks, rib bones and/or turkey necks. Buyer understands that not feeding Canine half of its daily food intake as raw, meaty bones voids the health portion of this Purchase Agreement.

E. Buyer agrees not leave Canine alone for more than five (5) hours at any one time without human contact. To do so means agreeing to the surrender Canine to Seller for a $500.00 refund.

F. Buyer agrees not to leave Canine in a boarding kennel, but instead to find a private home, friend or regularly used daycare with overnight facilities. Buyer agrees that a boarding kennel would be dangerous to Canine's well being.

Buyer and Seller hereby agree to all the terms herein above set forth by signing this Purchase Agreement.Any and all signatories hereto agree that he/she has fully read and fully understands this Purchase Agreement, and fully agrees to the entirety of this Purchase Agreement.
