Fino Lagotto (“Seller”) owns a Lagotto Romagnolo dog.

I, Buyer's full name ________________________, (“Buyer”) desire to purchase the Lagotto Romagnolo (“Canine”) described above.Now, therefore, in consideration of mutual promises contained in this agreement, Seller agrees to sell and Buyer agrees to buy Canine for $ "Purchase Price"____________________ (“Purchase Price"), transferring full title and possession of canine from Seller to Buyer as of the date of this agreement. The following warranties and conditions apply, and both Buyer and Seller agree that no other warranties or conditions are expressed or implied other than those stated herein.

Seller warrants that Seller holds full title to Canine free of any security agreement or other encumbrance. Seller retains the right in regard to Canine for a yearly prearranged visit to Buyer's home at Seller's expense.
Canine is pure-bred and pedigree is true and correct to the best of Seller's knowledge.
Canine is guaranteed to be in good health and free of communicable diseases at the time of sale.
Canine is guaranteed to five (5) years of age against any genetic defect that may arise that will lead to Canine's death. Should a claim arise under the terms of this agreement, Seller shall refund the Purchase Price to Buyer after confirmation of the claim. The Buyer may keep Canine if desired.
Canine is guaranteed against hip dysplasia as certified by PennHip or OFA at the age of two (2) years. This guarantee specifically excludes dysplasia caused by environmental factors, a deviation from the required feeding practices, or Buyer mishandling. Canine will stay placed with Buyer and decision on how to handle the hip dysplasia will be by the Buyer and his/her veterinarian at Buyer's expense. Seller shall refund the Purchase Price after confirmation of a claim of mid-level or severe hip dysplasia. Seller retains the right to refuse to sell future Canines to Buyer.
Buyer agrees to pay the cost of obtaining a Penn Hip or OFA-certifiable hip x-rays between 12 and 24 months of age and to send copies of the report to Seller.
The Buyer agrees to keep Canine for as long as he/she lives unless unforeseen circumstances arise. Should the Buyer not be able to care for this Canine, the Seller must be notified first and given the first option to reclaim Canine. This Canine may not be placed in another home without the written consent of the Seller.
Seller agrees to take possession and title of Canine, regardless of its age or physical condition, if the Buyer so requests. Buyer has four (4) weeks from the date of delivery of Canine to Buyer to decide if Canine is a good fit with Buyer's family and that Buyer can abide by all the terms and conditions of this Purchase Agreement. At any time during those four (4) weeks, the Buyer can return Canine for a full refund of the Purchase Price. Delivery costs will be borne by the Buyer at a rate of 300.00 per 24-hour period of travel time. Anytime during Canine's life after these four (4) weeks, Canine may be returned to Seller for a refund of $1,000.00 (one thousand dollars).
Canine must NOT be used for breeding. Seller will demand the return of the dog as well as any offspring. This puppy sold by the Seller is represented to the Buyer as "pet-quality" only.
This agreement constitutes the entire agreement between Seller and Buyer and supersedes any and all earlier negotiations or agreements.
This agreement cannot be modified except in writing signed by both Buyer and Seller.
This agreement shall be governed by and construed in accordance with the laws of the State of New Mexico.
The venue for any action under this agreement shall lie in Santa Fe County, New Mexico.
In the event that a court of competent jurisdiction enters a final judgment holding invalid any portion of this Purchase Agreement, the remainder of this Purchase Agreement shall be fully enforceable.

BUYER'S WARRANTIES

A. Buyer agrees to never place a choke, shock, or prong collar on Canine. The Buyer understands that to do so would be to approve of the surrender of the dog to Seller at a flat return rate of $500.00.
